Ask which company records and explanatory work are actually needed for the specific claim, and separate that preparation and legal assessment from official filing fees, optional processing services, and any family filings.
Avoid paying for an unsupported narrative
The company should identify the people who can verify the knowledge and the proposed assignment before commissioning a lengthy written description. Clarify whether the professional engagement includes reviewing confidential evidence, offsite work arrangements, or responding to later government questions, and confirm current filing fees for this specific employer.
Scope the knowledge proof before commissioning technical declarations or translations. Ask who can authenticate training, product history, comparative experience, and the proposed assignment; then budget legal review, secure document handling, corporate evidence, official charges, and family applications separately. If the beneficiary will be stationed primarily at an unaffiliated employer’s worksite, that employer cannot principally control and supervise the beneficiary, and the placement cannot be essentially an arrangement to provide labour for hire. Price the effort needed to document that operating control rather than buying a generic expert report. Specialized knowledge still must be special knowledge of the organization’s product, service, research, equipment, techniques, management, or other interests and their application in international markets, or an advanced level of knowledge or expertise in the organization’s processes and procedures. The recurring mistake is paying for volume before deciding which facts each exhibit proves.
Hypothetical example: an Ottawa photonics-equipment producer plans to place its laser-alignment specialist inside a semiconductor customer’s plant. Before agreeing on preparation costs, the employer should collect the service agreement, reporting lines, supervision plan, proprietary training history, and permitted technical samples. Counsel’s scope should distinguish confidentiality review from petition drafting and any later government response. A customer’s expensive project deadline neither proves specialized knowledge nor changes the prohibition against labour-for-hire placement.
