Weigh EB-5 project risk against the Gold Card gift using the household's actual risk tolerance

USAvisa field guide · 3 minute readReviewed 7 September 2026
THE SHORT ANSWER

EB-5 and Gold Card involve different financial exposures that should be measured against the household's own circumstances, including whether a household member holds a federal defined-benefit pension or other stable income that affects how much investment risk the family can reasonably absorb. Neither the EB-5 investment nor the Gold Card gift should be selected primarily because of its advertised immigration outcome without an honest look at what each actually risks financially.

01

Model the EB-5 project's realistic downside

Hypothetical example: an Ottawa household with a stable, pension-backed income is considering a specific regional-center offering. Ask what happens to the invested capital if the project underperforms, is delayed, or fails outright, and whether the household's other income sources can absorb a full loss of the invested amount without affecting near-term retirement plans, since EB-5 capital must remain at risk and is not a guaranteed return.

02

Treat the Gold Card gift as a noncommercial commitment

The official Gold Card FAQ describes the payment as a gift with a nonrefundable processing fee, not an investment with potential financial return. Confirm the current payment and refund terms and compare the required commitment against the EB-5 project's range of possible financial outcomes, rather than treating the two amounts as simply two prices for the same immigration result.

03

Match the timeline to the household's actual flexibility

Ask how long the regional-center project expects to hold investor capital before any return of principal, if applicable, and compare that to the household's own planning horizon, including any pension, retirement, or dependent's schooling timeline. Confirm current Gold Card and EB-5 processing information separately, and avoid assuming either path guarantees a specific date for permanent residence.

04

Compare the current commitments and immigration conditions

EB-5 currently requires US$1,050,000, or US$800,000 for qualifying targeted employment area or infrastructure cases, with statutory adjustments beginning January 1, 2027. Lawful at-risk capital, at least ten qualifying full-time jobs per investor and management or policy-formulation participation remain required. Gold Card processing is US$15,000 nonrefundable per person; after vetting and instructions, gifts are US$1 million per individual principal or US$2 million per corporate-sponsored employee principal. Each eligible included spouse or unmarried child under 21 adds US$1 million and US$15,000, including corporate cases. EB-1 or EB-2 eligibility, admissibility and visa availability still govern Gold Card.

05

Distinguish corporate costs and the residence stage

Corporate Gold Card terms add 1% annual maintenance and 5% transfer with a new background check, without automatic replacement approval. EB-5 contractual investor repayment rights and guaranteed rates of return are excluded from qualifying capital; the sole-discretion enterprise buyback exception has sustainment and other conditions. Petition approval itself grants neither residence nor work permission. EB-5 I-829 generally is filed in the 90 days before conditional residence’s second anniversary, not on a project repayment date.
