FOR SPECIALIST TEAMS · RUSSELLRussell

Your expertise.Across borders.

A hypothetical Russell employee will teach a US affiliate a process learned through a company apprenticeship. The file needs to show what knowledge the employee acquired and how the US work will use it. Completion of an internal course is evidence to assess, rather than automatic L-1B qualification.

Start with the L-1B eligibility and application overview

01

Explain knowledge in practical terms

The standard covers special knowledge of the company’s products, services, research, equipment, techniques, management or other interests and their application in international markets, or advanced knowledge or expertise in its processes and procedures. It need not be unique or proprietary. Describe the employee’s actual ability beyond a certificate’s title.

02

Prove a qualifying transfer

Establish the corporate relationship and the required continuous qualifying year of foreign employment within the relevant three-year period. Document US duties using the knowledge. Staffing scarcity or a customer’s request for this person does not replace the statutory criteria. The group must continue regular business in the United States and abroad. Qualifying foreign service may be managerial, executive or specialized knowledge, while U.S. work must meet L-1B; U.S. days do not count toward the foreign year, although brief visits do not automatically break continuity.

03

Identify who directs the training assignment

For work primarily at an unaffiliated employer’s site, assess actual control and supervision and the restriction on arrangements essentially supplying labour for hire. For a new office, sufficient premises and financial capacity to pay the worker and commence business matter; initial approval is limited to one year. At a primarily unaffiliated worksite, L-1B is unavailable if that employer principally controls and supervises the worker, or the arrangement is essentially labour for hire rather than a placement connected with the petitioning employer’s specialized-knowledge product or service. The qualifying foreign employment must be full-time. New-office treatment means the U.S. organization has been doing business for less than one year.

04

Separate general technical skill from employer knowledge

Provide the specialist's training history, the projects they led, and a statement of how many employees hold comparable knowledge. The knowledge need not universally be unique or secret, but general occupational skill alone is insufficient. Records may include controlled manuals, training histories, product-release material, project records, and detailed statements from knowledgeable managers. If part of the assignment will occur at a municipal client's plant, the petition must show the transferee remains directed and controlled by the petitioner, performing work involving its specialised knowledge, rather than being supplied as labour to the client. Deep skill in a widely sold platform, however scarce good practitioners may be, generally belongs to the industry rather than to the employer, and vendor training certificates argue against the petition as often as for it. Obtain training history, project records, controlled procedures and supervisors' explanations, then connect each record to a particular capability. Training sequence, implementation records, system access, and examples of problem solving can show how the knowledge differs from ordinary familiarity. Link the employee’s knowledge to named features, implementation choices or methods that the petitioner delivers.

05

Identify the specific knowledge, not the years of service

Set out who assigns the work, who supervises it, who pays whom, and how the specialized knowledge is applied at the third-party location. Knowledge need not always be unique or proprietary, but a training plan cannot be presented as proof that the applicant already possesses the knowledge on which the case relies. The file should identify which knowledge supports L-1B without falsely claiming that common tools are proprietary or that all experienced users are interchangeable. The file should explain what the beneficiary knows, how it is special or advanced, how it was obtained and why the proposed duties require it; proprietary material can support that explanation without becoming a mandatory element. If the answer is a specific procedure the company developed, applied across its sites and trained this person on over years, the file has something that can be evidenced.
