Do not confuse completing studies with acquiring citizenship

THE SHORT ANSWER

Education, Canadian permanent residence and citizenship are separate facts. A Russell resident who finishes a Canadian programme should identify which nationality they actually hold before assuming a new credential makes TN available.

01

Establish the nationality already held

TN principal eligibility requires Canadian or Mexican citizenship. Canadian permanent residence and a Canadian diploma do not supply it. A pending citizenship application remains a different process with its own outcome.

02

Compare another route only on its real requirements

E-2 may depend on an existing treaty citizenship and the enterprise’s qualifying nationality and investment. L-1 instead requires a qualifying company transfer and employment history. Do not treat either as an automatic alternative for every person who cannot use TN.

03

Prepare the household record accurately

List each person’s citizenship, relationship, proposed activity and documents. A spouse’s different nationality does not automatically eliminate derivative options, but status and work permission need separate review. Use the current facts rather than projecting the whole household into a future citizenship scenario.

A CONVERSATION IS A GOOD PLACE TO START.
