PROGRAMME BRIEFING · RUSSELLRussell

A new route.Know the details.

A hypothetical Russell household is comparing an individual Gold Card application with a promised employer reimbursement. Identify who is applying under which government framework and who is privately agreeing to pay. A reimbursement promise does not automatically turn an individual application into corporate sponsorship.

Start with the GOLD CARD eligibility and application overview

01

Identify the actual programme arrangement

The official framework remains subject to EB-1 or EB-2 eligibility, admissibility and visa availability. The gift is not EB-5 capital, an equity purchase or a guaranteed route to citizenship. Employer willingness to fund it does not settle those immigration conditions.

02

Separate published charges from private reimbursement

The nonrefundable processing fee is US$15,000 per person. After vetting, when instructed, the individual principal gift is US$1 million or the corporate-sponsored employee principal gift US$2 million per employee. Each eligible included spouse or unmarried child under 21 adds US$1 million and US$15,000, also in corporate cases.

03

Review conditions before treating support as available

Corporate terms include separate 1% annual maintenance and 5% transfer charges under their conditions, including new vetting. Do not assume automatic transfer or reuse. A private reimbursement or repayment clause must be read separately from these government terms.

04

Follow the official payment sequence and individual amounts

Official State Department visa and medical costs may also arise; neither a private all-inclusive quote nor payment itself guarantees residence, work permission, approval or a completion date. A first review should create a payment-control checklist: the applicant identity, the government instruction, the stated amount, the recipient account, the condition that triggered the request, and the retained receipt. Each applicant must be eligible for lawful permanent resident status, admissible and covered by an available visa, and Executive Order 14351 directs the gift to be treated as evidence under specified EB-1 and EB-2 grounds. A program label does not tell a household whether it has a filing mechanism, an approved payment channel, a derivative-family rule, or an immediate immigration consequence. Before a payment is authorized, the official programme material and any accompanying presidential action should be read in their current form, and the amounts, the sequence of steps and the treatment of family members should be confirmed there. Compare the legal evidence required, family treatment, financial exposure, and tax consequences of each route independently, and recheck the current official instructions before acting, since a government FAQ is a dated reference rather than a permanent guarantee that every term stays unchanged. Sequence private and public obligations carefully: review the sponsor contract, confirm the applicant’s independent immigration facts, complete verified payment instructions, and preserve the result for the filing. The practical decision is whether a government source actually directs the next step or merely describes a prospective framework; if the direction is absent, pause rather than fill the gap with an intermediary's interpretation.

05

Check the immigrant-category requirements still apply

Successful applicants proceed through existing employment-based classifications, and the published material refers to the first and second employment-based preference categories. The official FAQ identifies an eligible spouse and unmarried children under 21 and recommends initial inclusion of intended joining relatives. The gift follows successful vetting under the official description and is not an EB-5 investment with an expected return. Establish first whether you satisfy the requirements the official process sets, including any underlying immigrant category basis it relies upon, and whether anything in your history — a prior refusal, an overstay, a criminal matter — would be an obstacle under general admissibility law. Before relying on a replacement arrangement, establish who the sponsor is, which application the proposal concerns and what official instructions apply. A legitimate commercial adviser can explain a transaction, but cannot convert a private fee into the U.S. government payment described by the program. The official process still requires the applicable EB-1 or EB-2 analysis, admissibility and visa availability as determined in the case. If an adviser proposes to hold funds and pay on the applicant's behalf, ask how the payment will be made, what confirmation the applicant will receive directly, and what happens to the money if the instruction never comes.
