RUSSELL · BUSINESS ROUTE COMPARISON

Compare a telecom-sector transfer and an unrelated business purchase without borrowing facts between them

USAvisa field guide · 2 minute readReviewed 7 September 2026
THE SHORT ANSWER

An Ottawa telecommunications-equipment employee may have both an internal transfer opportunity within their current multinational employer's U.S. affiliate and a separate, personal opportunity to acquire an unrelated small U.S. manufacturing business. Assess the intracompany transfer under L-1 using the actual employer relationship and role, and assess the acquisition under E-2 using the actual ownership, funding and enterprise facts, without treating professional success in one context as evidence supporting the other.

01

Confirm the actual corporate relationship for the transfer option

Identify the Canadian employer's exact legal relationship to the proposed U.S. affiliate, including ownership percentage and any joint-venture terms, and gather the employee's own qualifying foreign employment history and proposed U.S. duties. A large multinational employer's name recognition does not itself establish the specific qualifying relationship or the beneficiary's specialized-knowledge or managerial role. L-1 requires a continuous qualifying foreign year within the relevant three years and continuing U.S. and foreign business through the qualifying group.

02

Assess the acquisition on its own ownership and funding facts

For the unrelated manufacturing business, identify the investor's treaty nationality, the proposed ownership and control structure, and the lawful source and path of the acquisition funds, independent of the employee's standing at the telecom employer. Employment income from the current job may fund part of the investment, but that income source needs its own documentation rather than being assumed sufficient because the employer is well known. E-2 also requires substantial qualifying capital committed at risk, at least 50% relevant treaty-country national enterprise ownership, a real nonmarginal business the investor develops and directs, and intent to depart when E status ends.

03

Keep the household decision tied to both sets of real conditions

List what each option would require of the household, including relocation timing, the spouse's work plans and children's schooling, and compare the actual conditions of the internal transfer against the actual conditions of the business purchase. A stable, familiar employer relationship on one side does not make the immigration analysis for the acquisition easier, and an attractive purchase price does not simplify the transfer's own qualifying-relationship and role evidence.
