Read the general business expansion overview
Where the new U.S. office's actual function, such as a trucking terminal or distribution operation, depends on obtaining a state or federal operating authority or permit before it can function, that authorization is a separate precondition from the L-1A evidence itself, and the petition should describe its current status honestly rather than assuming the office is operational once a lease is signed.
Identify the specific authority or permit required
Confirm which state, federal or local operating authority, licence or permit the business actually needs before it can conduct the proposed activity, and identify who is responsible for obtaining it and the realistic timeline.
Distinguish a signed lease from an operating business
A signed lease establishes premises but not necessarily an operating business if a required authority or permit is still pending. Describe what activity can occur before the authority is granted, if any, and what remains contingent on it.
Update the extension record with the authority's actual outcome
Record the date the authority or permit was actually granted, any conditions attached, and how that changed the office's real staffing and activity, since the extension needs evidence of what actually happened, not a restated version of the original plan.
Check the new-office eligibility behind the plan
A U.S. organization doing business for less than one year is a new office. Establish the qualifying corporate relationship and continuous foreign year within the relevant three years. New-office L-1A specifically needs foreign managerial or executive service, sufficient premises and support for the U.S. managerial or executive role within one year of approval; initial approval is at most one year. The qualifying group must continue business abroad as well as establish U.S. operations. The foreign year must be full-time; brief U.S. visits need not break continuity but their days do not count toward it. For L-1B new offices, show qualifying specialized knowledge, sufficient premises and financial ability to pay the worker and commence business; initial approval cannot exceed one year.
