THE SHORT ANSWER

A Clarence-Rockland production employee may have both a proposed L-1B secondment to help commission a new U.S. plant line and a separate, personal opportunity to buy an unrelated U.S. maple-product or agri-tourism retail property a relative is selling. Assess the secondment under L-1B using the applicant's actual specialized knowledge and the employer relationship, and assess the property purchase under E-2 using the actual ownership, funding and enterprise facts, without letting either proposal borrow credibility from the other.

01

Establish the specialized-knowledge claim for the secondment on its own facts

Identify precisely what process or product knowledge the employee has and how it will be used to commission the new plant line, and gather the qualifying foreign employment history independent of any interest in the unrelated property purchase. L-1 requires a continuous qualifying foreign year within the relevant three years and continuing U.S. and foreign business through the qualifying group.

02

Assess the property purchase on its own ownership and funding facts

For the agri-tourism property, identify the investor's treaty nationality, the proposed ownership structure, and the lawful source and path of the purchase funds, independent of the employee's standing at the manufacturing employer. A family relationship with the seller does not itself establish substantiality or non-marginality. E-2 also requires substantial qualifying capital committed at risk, at least 50% relevant treaty-country national enterprise ownership, a real nonmarginal business the investor develops and directs, and intent to depart when E status ends.

03

Weigh the household consequences of each option honestly

List what each option would actually require, including relocation timing, the spouse's plans and children's schooling, and compare the real conditions of the secondment against the real conditions of the property purchase rather than assuming familiarity with one employer makes the unrelated purchase easier to evaluate.
