Weigh resignation against leave when a spouse's workplace has no leave-without-pay provision

THE SHORT ANSWER

A Clarence-Rockland household should obtain the actual employer or collective-agreement terms before relying on leave, a return to work or benefits during an absence. Compare the confirmed options with the U.S. immigration plan; do not infer a right to leave or recall from another workplace’s experience.

01

Confirm what the collective agreement actually allows

Hypothetical example: one spouse works a unionized shift at a local food-processing plant and assumes an extended leave will be approved the way it was for a friend at a different workplace. Ask the union steward or human resources what this specific agreement provides for an extended absence, including whether recall rights, seniority or benefits are preserved, since these terms vary by employer and bargaining unit and should not be assumed from another workplace's practice.

02

Plan school continuity as a logistics question

Record each child's current program, including continuity of French-language instruction the family values, and their age and status dates separately. TD or eligible E/L dependent status can permit study while the underlying status is maintained, but continuing a specific bilingual program in the United States is a school-availability question, distinct from whether status permits study at all.

03

Identify the consequence if resignation, not leave, is the only option

If the requested leave is unavailable, ask the employer or union what other arrangements, if any, exist and what leaving employment would mean under the actual terms. Keep that answer separate from visa eligibility and timing; do not assume resignation preserves a right to return.

04

Check permission before planning the spouse’s work

Dependent eligibility generally concerns a spouse and unmarried children under 21. TD permits study but not employment. Qualifying E or L spouses may work incident to appropriate status with the necessary evidence; children do not receive that spouse permission. A leave approval or the principal’s petition does not establish the relative’s status.
