IN THIS GUIDE · Evaluate a targeted-employment-area claim and the investment risk independently, not as a package
Verify the targeted-employment-area designation independently
Identify the project location, the rural or high-unemployment basis claimed, the relevant USCIS designation or project approval and its applicable dates. Review whether that determination applies to this investor and the actual project, including any material change. Do not assume a brochure establishes qualification, or that an earlier official determination is irrelevant simply because another investor obtained it.
Connect the investment to qualifying jobs
The program generally requires at least ten permanent full-time positions for qualifying U.S. workers, and a regional-center project typically relies on an economic-impact study to count indirect and induced jobs rather than only direct hires. Ask which methodology the study uses, how sensitive its job count is to the project's actual performance, and what happens to the investor's case if the built project creates fewer jobs than projected.
Document the lawful source and path of capital
Hypothetical example: an Ottawa investor plans to fund the subscription using a mix of a matured registered investment account, proceeds from a jointly held property sale, and a family gift routed through a relative's account. Each source needs its own dated documentation, account statements, the sale agreement and closing documents, and a gift letter with the giver's own source records, rather than a single combined bank statement showing the final subscription amount.
Plan for the immigration stages and the household
The process generally involves an investor petition, an immigrant visa or adjustment-of-status stage where available, and later removal of conditions. Visa availability and individual circumstances affect the sequence. Include each family member's age and objectives early, including whether a child currently attending an Ottawa school under a French-immersion or specialized program would need to change schools at a specific immigration stage, since a payment or petition filing does not itself freeze a child's CSPA age.
Preserve the investment’s legal conditions
Qualifying capital must be lawfully sourced and at risk, with investor participation in management or policy formulation. Gifted or borrowed funds must be provided in good faith and not to circumvent permissible-capital restrictions. Contractual investor repayment rights and guaranteed rates of return are excluded; an enterprise’s sole-discretion buyback exception remains subject to sustainment and other requirements.
Track conditional residence rather than investment anniversaries
Petition approval is not itself residence or work authorization. After the appropriate immigrant admission or adjustment, I-829 generally must be filed during the 90 days before the second anniversary of conditional residence. Filing does not automatically remove conditions or guarantee repayment.
