A relative's existing ownership stake in the U.S. business does not itself grant the investor's own spouse or children any status; each household member's own citizenship, relationship and intended activity still needs individual review, separate from the relative's ownership interest.
Keep the relative's ownership and the household's status questions separate
Document the relative's existing ownership percentage and role in the business, and identify whether that changes the investor's own proposed control of the enterprise. Separately confirm each accompanying family member's citizenship and intended work or study plan, since a qualifying E spouse's incident-to-status employment authorization does not depend on which relative already owns part of the company. Eligible dependents generally include a spouse and unmarried children under 21. Children do not receive the qualifying E spouse’s employment permission; the spouse needs actual appropriate status and evidence.
Draw an ownership chart and a separate household chart. List nationality, percentage, voting power, and management rights for each owner; separately record every relative’s relationship, citizenship, age, and intended activity. A qualifying E-2 investor must develop and direct an enterprise that is at least 50% treaty-national owned. A spouse in E-2 dependent status is employment-authorized incident to status, while children do not receive that work authorization. The recurring mistake is assuming a relative’s shares either grant status to the household or automatically supply the principal’s operational control.
Hypothetical example: a Clarence-Rockland hardware-store operator proposes to acquire an American building-supply shop in which a Canadian-citizen cousin already owns a minority stake. The buyer checks her directing power and every owner’s nationality. Her spouse plans unrelated employment and retains appropriate E-spouse status evidence; their child plans only school. The cousin is not added to the dependent application merely because of ownership. This record keeps the enterprise’s treaty-nationality calculation independent from the investor’s qualifying family relationships.
