Check the actual agreement and employer response before relying on leave, return or benefit arrangements. Those workplace terms are separate from the spouse’s eligibility for L-2 and the evidence of any incident-to-status work authorization.
Check the collective agreement before assuming leave is available
Ask the union or human resources department what the specific collective agreement actually provides for an extended absence, including seniority, benefits and recall rights, since these terms vary by employer and bargaining unit and are not governed by immigration law. Keep that employment decision separate from the L-2 dependent's own status and any future employment plans in the United States. Dependent eligibility generally concerns a spouse and unmarried children under 21. Children do not receive the qualifying L spouse’s work permission; verify the spouse’s own status evidence before U.S. employment.
Review the spouse’s collective agreement, human-resources policies, benefit documents, and any written leave decision before setting a departure date. Record whether resignation, unpaid leave, remote duties, or recall rights are actually available; none is created by L-2 classification. In the United States, an L-2 spouse is employment-authorized incident to status. Children do not receive that permission. Keep those immigration points apart from Canadian seniority consequences. The mistake is relying on another bargaining unit’s arrangement instead of obtaining controlling workplace terms.
Hypothetical example: a laboratory technologist at a Clarence-Rockland food-testing company plans to accompany a spouse transferred for proprietary feed-mill controls. Her union agreement permits a shorter absence than the family expected and says nothing about remote laboratory review. She requests a written employer decision, compares resignation and leave consequences with Canadian advisers, and does not promise a return date to a prospective U.S. employer prematurely. After entering in proper L-2 status, she retains the status evidence needed for American employment verification while the couple separately calendars the principal’s L-1B limits.
