A change to funding or contractual obligations can matter to the case. Obtain review of the actual facts and stage promptly.
Keep the investment and immigration records consistent
Provide amendments, default notices or revised payment terms. A pending petition does not suspend private obligations or guarantee that a changed arrangement still qualifies.
Treat a missed installment as a contractual development requiring prompt review. Gather the default notice, payment history, agreements, correspondence, and revised funding plan. EB-5 capital must be at risk and either be invested already or remain in an active investing process; the required sustainment period depends on the filing date of the underlying investor petition. For a petition filed before March 15, 2022, the investment generally must remain at risk throughout conditional residence; for one filed on or after that date, current USCIS guidance generally measures a two-year period from when the full qualifying investment was contributed, placed at risk, and made available to the job-creating entity as applicable; a pending petition does not transform an unfunded promise into capital or suspend deadlines. Reconfirm US$1,050,000 for a standard project, or US$800,000 when the project is infrastructure or its targeted employment area is rural or high unemployment, alongside ten required full-time positions for qualifying U.S. workers. Update lawful-source and path evidence for replacement funds. The common mistake is waiting for USCIS action while the commercial record contradicts the filed account.
Hypothetical example: A Russell food-distribution owner misses the second payment for a regional-center warehouse after a business-sale closing is postponed. He should notify counsel, preserve the project’s response, and assess any amended obligation before sending substitute funds. Because this is a regional-center investment, Form I-526E is the applicable petition; its pendency does not excuse the default. Any funding source needs a documented path to the enterprise. If conditional residence is later obtained, Form I-829 normally must be filed during the 90 days immediately before the second anniversary; USCIS may accept a late filing only for good cause and extenuating circumstances, so all investment and job records should remain organized through that stage.
