Can the spouse deliver a separate part of the training programme?

THE DIRECT ANSWER

Assess the spouse’s own authorization and actual teaching duties before adding an instructor. A principal’s L-1B case does not automatically authorize another family member to provide part of the service.

Identify who would teach each session

Suppose the employer’s draft syllabus names the transferee for technical demonstrations and the spouse for customer exercises. Ask who proposed the second assignment, where those exercises would take place and what preparation or delivery the spouse would perform. Keep the syllabus accurate rather than removing the spouse’s name while expecting the same work. A qualifying L spouse may work incident to appropriate status with the required evidence, but a pending dependent application or the principal’s approval is not that status. Check the spouse’s actual admission or status documentation before committing to delivery; calling a session unpaid does not automatically make it permissible. Dependent eligibility generally covers a spouse and unmarried children under 21, and children do not receive the spouse’s work permission. If the spouse cannot teach on the intended date, have the employer identify another lawful delivery arrangement instead of assuming the principal’s classification covers the whole household. The instructor list and the immigration account should describe the same real plan.

Give every proposed instructor a name, task and authorization basis before finalizing the programme. An L-2 spouse is employment-authorized incident to status, but a planned application or the principal’s L-1B approval is not the spouse’s status; dependent children do not gain that work authorization. Calling instruction voluntary or bundling it into the principal’s syllabus does not resolve whether it is work.

Hypothetical example: A Russell logistics-software implementation specialist will teach a U.S. affiliate its proprietary routing configuration, while his spouse, a payroll trainer, is listed to lead compensation exercises. The petitioner should remove that commitment unless the spouse will hold qualifying L-2 status before performing it, or assign an authorized employee. Meanwhile, L-1B requires either special knowledge concerning the organization’s products; its services and research; its equipment and techniques; its management or other interests, and their international application, or organization-process and procedure knowledge at an advanced level.
