Should we pay to create a new certification solely for the visa file?

THE DIRECT ANSWER

A newly purchased label cannot replace evidence of existing qualifying knowledge. First identify what the actual case needs.

Spend on clarifying real evidence

Relevant record collection or a clear explanation may be useful. Distinguish business training expenses from government and professional charges, and avoid assuming every case requires an outside certification.

Start with existing evidence: apprenticeship records, authored procedures, incident reports, peer comparisons. Ask which factual gap a proposed certification would fill and whether the issuing body could genuinely verify past company knowledge. It cannot replace qualifying employment or actual duties. L-1B demands special knowledge of the company’s product, service, research, equipment, techniques, management, or other interests and their application in international markets, or an advanced level of knowledge or expertise in the company’s processes and procedures. It also requires a qualifying parent, branch, subsidiary, or affiliate link and generally a continuous year of full-time work abroad inside the relevant preceding three-year period. Separate legitimate training and evidence costs from government charges, without quoting filing-fee figures.

Hypothetical example: A Russell wood-products machinery diagnostician is proposed for a U.S. affiliate that uses the same company-built control system. The employer considers paying a consultant to invent a “master technician” certificate. A better sequence is to document the diagnostician’s repairs, unusual fault isolation, training history, and knowledge of company revisions, then explain the U.S. tasks. If genuine retraining is commercially necessary, record it honestly; do not back-form a credential solely to decorate the petition. Except under the initial U.S. new-office rules, qualifying organizations must continue doing business in America and another country during the assignment.
