Can my spouse start working while I finish the TN credential review?

THE DIRECT ANSWER

A planned TD classification does not authorize employment, and TD status itself does not provide work permission. The spouse’s proposed activity requires its own lawful basis.

Avoid a household start-date assumption

List where the spouse would work and what they would do. The principal’s pending credential review or employer offer cannot authorize another person’s US employment. Eligible TD dependents generally are a spouse and unmarried children under 21; TD permits study but not work.

Sequence the household around work authorization, not the principal’s expected approval. A TD spouse or child cannot work in TD status, although either may study; a spouse may work only when otherwise authorized by DHS. Identify independent authorization if employment is essential. The common error is assuming that unpaid productive services are automatically permitted. The principal must independently show Canadian or Mexican citizenship—not Canadian permanent residence—plus prearranged professional activity for a U.S. or foreign employer in an Appendix 2 to Annex 16-A profession and the profession’s own credential. TN self-employment is not allowed.

Hypothetical example: A Russell veterinarian expects to join an American clinic after her credential review, while her spouse plans to manage bookings for a separate pet-supply distributor. They should not schedule the spouse’s customer work from TD admission. The couple can gather marriage and citizenship records while separately evaluating authorization for the booking role. If the veterinarian is Canadian, she may choose a port-of-entry application or an employer’s Form I-129 with the clinic’s letter or contract, but neither her pending review nor later TN admission authorizes her spouse’s job.
